Interventions aimed at raising awareness, disseminating and remembering the tragedy of the foibe and the Istrian-Fiuman-Dalmatian exodus.

Urgent provisions on culture.

THE REGIONAL COUNCIL HAS APPROVED

THE PRESIDENT OF THE REGION PROMULGATES the following law:

Head I

INTERVENTIONS AIMED AT KNOWLEDGE, DIFFUSION AND REMEMBRANCE OF THE DRAMA OF THE FOIBE AND THE ISTRIAN-FIUMIAN-DALMATIAN EXODUS

Art. 1. Principles

1. The Friuli-Venezia Giulia Region implements, promotes and supports activities aimed at disseminating and enhancing the historical, cultural, literary and artistic heritage of the memory of the victims of the foibe and the exodus from their lands of the Istrians, Fiume and Dalmatians, a national tragedy and testimony to the brutal violation of the principles of freedom, respect for human rights, self-determination of peoples, proclaimed by the UN Charter, and the Universal Declaration of Human Rights.

2. The Friuli-Venezia Giulia Region, for the purposes referred to in paragraph 1, also in compliance with the provisions of Law No. 30 of 2004 March 92 (Establishment of the "Day of Remembrance" in memory of the victims of the foibe, the Julian-Dalmatian exodus, the events on the eastern border and granting recognition to the relatives of those killed in the foibe), promotes actions aimed at spreading, by suitable means, knowledge of the tragic events among young people in schools of all levels and universities.

3. The activities referred to in this article are also carried out in order to promote among the younger generations the diffusion of the feeling of belonging to the Fatherland and the valorization of the principles of freedom, democracy and national unity enshrined in the Constitution, encouraging greater knowledge of the historical and cultural roots of the Friuli-Venezia Giulia Region and of the Italian Republic as a whole.

Art. 2. Activities

1. The activities referred to in art. 1 are aimed at schools, universities and local authorities and may concern:

a) the publication of studies, research, essays and audiovisual material, collection of materials and testimonies regarding the events of the victims of the foibe and the Istrian-Fiuman-Dalmatian exodus;

b) initiatives aimed at spreading historical knowledge of the tragedy of the foibe and the Istrian-Fiuman-Dalmatian exodus among young people, in schools, universities and workplaces;

c) the setting up of exhibitions and the organisation of study conferences, debates and educational trips to the places of memory in Italy and in those now included in the state territory of the Republic of Slovenia and the Republic of Croatia;

d) competitions, prizes and contributions to degree theses, literary, cinematographic and theatrical works;

e) celebratory events in the Julian, Istrian, Fiume and Dalmatian areas, the scene of significant episodes of the tragedy of the exodus and the foibe, with the involvement of the associations formed to disseminate the activities, as indicated in art. 1, paragraph 1;

f) moments of meeting with the Italian communities and schools present in the Republics of Croatia and Slovenia;

g) initiatives other than those provided for in this article which are however inspired by the purposes and principles set out in art. 1.

Art. 3. Regional competition of schools of Friuli-Venezia Giulia and "Day of Remembrance"

1. The Friuli-Venezia Giulia Region annually announces a competition called "Foibe and Exodus: A Memory Not to Be Forgotten", reserved for students of primary and secondary schools, first and second level, state and private, and of education and training courses at state professional institutes and accredited training bodies of Friuli-Venezia Giulia. Projects can be presented in text, graphic or multimedia format.

2. The judging commission of the competition is constituted by decree of the President of the Region. The commission is normally chaired by the President of the Regional Council, or by a member of the Presidency Office delegated by him, and it includes six experts designated, one each, by the following associations:

a) Trieste National League;

b) February 10 Committee;

c) Regional Institute for Istrian-Fiuman-Dalmatian Culture;

d) Association of Istrian Communities;

e) Union of Istrians;

f) National Association of Venezia Giulia and Dalmatia.

3. A member may also be designated by the regional school management, within the scope of its functions, chosen from among the teaching staff.

4. The members of the commission serve on a voluntary basis. The members designated by the associations referred to in paragraph 2 and by the regional school board are entitled to reimbursement for expenses actually incurred, within the limits and in the manner provided for regional employees.

5. The competition announcement is announced and communicated to all schools in Friuli-Venezia Giulia, as defined in paragraph 1, by November 30 of each year, and the works must be sent to the competent management by the date indicated in the announcement, established in such a way as to allow evaluation and proclamation by the end of January of the following year. The winners are awarded on February 10 of each year, or on the first available working day, on the occasion of the celebration of the "Day of Remembrance", established by law no. 92/2004.

6. For the purpose of evaluating the projects, three categories are identified, based on the levels of education, for each of which two winning projects are designated.

7. The students proclaimed winners of the competition, in a number not exceeding six, and their companions, one per person, are rewarded with a trip, at the expense of the Friuli-Venezia Giulia Region, to the lands of Venezia Giulia, Istria, Fiume and Dalmatia, according to itineraries prepared annually and with visits to the Basovizza and Monrupino sinkholes, to the Padriciano Refugee Collection Centre Museum and to Warehouse 18, as well as to other symbolic places of the Julian-Dalmatian tragedy identified and accessible from time to time.

8. The "Day of Remembrance" of each year is commemorated with an official event in the Council Chamber, also organized with the patronage of the Office of the Presidency of the Regional Council. In conjunction with the official event, the award ceremony for the winners of the competition takes place.

9. The competition regulations are adopted by resolution of the Regional Council, after hearing the opinion of the competent council commission. Art. 4. Regional incentive for the valorization of historical memory 1. Pending the revision of the regulations issued by decree of the President of the Region of 23 May 2016, no. 110 (Regulations on annual funding for activities of regional relevance of associations of Istrian, Fiume and Dalmatian refugees based in the regional territory, and of the federation of the same, in implementation of art. 27, paragraph 4, of regional law 11 August 2014, no. 16 (Regional regulations on cultural activities)), for the year 2020, the deadline for submitting the application for the incentive provided for therein by art. 6, paragraph 3, is postponed to 30 April 2020.

Art. 4. Regional incentive for the valorization of historical memory

1. Pending the revision of the regulation issued by decree of the President of the Region of 23 May 2016, no. 110 (Regulation on annual funding for activities of regional relevance of associations of Istrian, Fiume and Dalmatian refugees based in the regional territory, and of the federation of the same, in implementation of art. 27, paragraph 4, of regional law 11 August 2014, no. 16 (Regional regulations on cultural activities)), for the year 2020, the deadline for submitting the application for the incentive provided for therein by art. 6, paragraph 3, is postponed to 30 April 2020.

Art. 5. Implementation of activities

1. In order to achieve the purposes set out in art. 1, the Regional Administration is authorised to grant contributions as a contribution to the costs of carrying out the cultural and educational activities set out in art. 2.

2. Within sixty days of the date of entry into force of this law, following the opinion of the competent council commission, in accordance with the provisions of regional law 20 March 2000, n. 7 (Consolidated text of the rules on administrative procedure and right of access), the following are determined:

a) the type of beneficiaries;

b) the criteria, methods, limits and maximum admissible amount for the granting and disbursement of contributions.

Art. 6. Financial regulation

1. For the purposes set out in Article 3, paragraph 4, a total expenditure of 7.500 euros is authorised, divided into 2.500 euros for the year 2020, 2.500 euros for the year 2021 and 2.500 euros for the year 2022, to be drawn from mission no. 1 (Institutional bodies) – programme no. 11 (Other general services) – title no. 1 (Current expenditure) of the budget expenditure forecast for the years 2020-2022.

2. For the purposes set out in art. 3, paragraphs 1 and 7, a total expenditure of 52.500 euros is authorised, divided into 17.500 euros for the year 2020, 17.500 euros for the year 2021 and 17.500 euros for the year 2022, to be drawn from mission no. 4 (Education and the right to study) programme no. 2 (Other non-university education orders) – title no. 1 (Current expenditure) of the budget expenditure forecast for the years 2020-2022.

3. For the purposes set out in art. 5, a total expenditure of 90.000 euros is authorised, divided into 30.000 euros for the year 2020, 30.000 euros for the year 2021 and 30.000 euros for the year 2022, to be drawn from mission no. 5 (Protection and enhancement of cultural assets and activities) – programme no. 1 (Enhancement of assets of historical interest) – title no. 1 (Current expenditure) of the budget expenditure forecast for the years 2020-2022.

4. The costs arising from the provisions of paragraphs 1, 2, and 3 shall be covered by means of a withdrawal of an equal amount for each of the years 2020 to 2022 from mission no. 20 (Funds and provisions) – program no. 3 (Other funds) – title no. 1 (Current expenditure) of the budget expenditure forecast for the years 2020-2022.

5. Pursuant to Article 10, paragraph 4, of Legislative Decree No. 23 of 2011 June 118 (Provisions on the harmonisation of accounting systems and budget formats of the regions, local authorities and their bodies, pursuant to Articles 1 and 2 of Law No. 5 of 2009 May 42), the table entitled "Attachment of budget variation act containing data of interest to the treasurer" referred to in Annex 8 of the same Legislative Decree is attached.
